>> sounds great. look forward to having you all week with us. >> have a good time. take it easy down there. it's a long week. >> no kidding. the future home of the niners santa clara is where the fans gathered yesterday to send the team off. that's how you do it. they mobbed the outside of the team's training facility to say good-bye and good luck. many fans have waited a long time to see this again and they are thrilled. >> we're excited. the niners are going to the sixth super bowl. hopefully they come back with a win. no doubt they'll come back with a win. >> i'm sure kaepernick is going to do it. he's going win six super bowls. >> the team's name is the san francisco 49ers but they are really playing for all of the bay area. even the little fans out there. >> a bunch of cuties ready to go. so is "today in the bay's" marla tellez live in santa clara right now with that side of the story.

marla, good morning. >> reporter: good morning to you. we're at the future home of the san francisco 49ers. the stadium of course in santa clara. what's going on between these two cities, san francisco and santa clara, is not something that we've seen before. call it the tale of two cities. both are extremely proud of the red and gold. but as niners relationship with candlestick in san francisco starts to wind down just as the team heads to the super bowl, santa clara is quick to stake a claim to the team though doing so quietly. other than this massive construction site, there's not a lot of niners fanfare around town. santa clara city hall is not lit up in red and gold. we drove by there this morning to check that place out. neither is mayor ed lee's office in san francisco. as for online world, a little bit of love on the city of san francisco's website. they put up a 49ers logo next to a spirited picture of the tower. you can find that on your homepage and on santa clara's

website you'll find a link to a super bowl pet adoption special all to honor the 49ers. what about a victory parade? mayor ed lee is not saying one way or the other at this point if san francisco will in fact host a parade if the niners bring home a sixth super bowl championship. so does this mean santa clara will host one? that's not likely. in niners keep playing like they are now, santa clara could one day plan that victory parade. marla tellez, "today in the bay." >> you're right at the foot of it right now. looks like it is going up in mi nice progress. how is it going? >> reporter: in terms of construction out here? >> how does the building look? does it look like it's coming along? >> reporter: i haven't been out here in probably -- i don't know -- at least six months. i was taken aback to see it from this side.

east bay. 880 moves smoothly. we just got this in from our photographer over there. that thing laying on the ground is supposed to be up in the air. a pole knocked down. power pole took out lights in the area. you see light traffic here where video is. as the morning continues it starts to build because it's a major thoroughfare along parallel to 880. that's where it is right now. that is taking out that area and 1,000 customers without power. we're tracking that at the news desk. 880 through the area shows a smooth drive. that's the area where we see volume kick in early. we'll track that. likely an issue at least for local drivers through the area. south bay moves smoothly for your northbound commute routes. we'll show you had southbound 17 reports of a stall. a camper trailer there that will block one lane as you head south toward the summit. no slowing on sensors. back to you. chp is trying to figure out what caused a seven-car pileup sending a dozen people to the hospital around 6:30 last night

at 101 and interstate 880. those seven vehicles were involved and no major injuries. a recent rash of theft and burglaries in san jose have neighbors on edge. a neighborhood safety meeting drew so many people last night they all just couldn't fit into the pizza parlor where the meeting was being held. one tips offered to neighbors there, band together. >> let the neighbors know how to protect each other and how to keep an eye open for each other and organize through the neighborhood watch program and ultimately be the eyes and ears of the police department. >> neighbors say they are worried the police do not have enough officers in that area. many neighbors showing up because of a recent home invasion robbery in which an elderly couple was tied up. a group of boat dwellers in redwood city are appealing to the city council to keep their homes. the city council will hold a hearing today on plans for the redevelopment of pete's harbor.

the justice department this morning is cleaning up the mess on one of its websites after a weekend hack attack. the group unanimous claiming responsibility. >> you see people in person and they wear the masks. a loose coalition of hackers and

activists. they hit a website run by the justice department in protest over the prosecution of aaron schwartz. this morning the boston globe, schwartz's hometown newspaper wrote an editorial condemning the prosecution as well. with exxon you get the market capitalization. you do the same for apple and you get 412 billion. apple is now the second most valuable company. so with that in mind, let's turn to jackie deangelis for a look at the markets. good morning, jackie. >> good morning, scott. futures slightly lower after the markets come off another positive week. the dow, nasdaq, s&p 500 have lost gains in the past four weeks. the dow is up 6% this month. also on pace for its best january performance since 1989 when it rose 8%. the s&p has risen for the past

eight sessions. the best win streak since 2004. it's also a busy week for economic data topped out by friday's jobs report. today we get numbers on durable goods and pending home sales and earnings just out from c caterpillar. dow rising 70 points on friday to close at 13,895. nasdaq up 19 points to 3149. back to you. >> thank you. as far as that yahoo news, we'll hear about the company's financials. i think what we're going to want to hear about are yahoo!'s customers. how many users, how long they stick around on the site. what sort of improvements yahoo! has planned ahead. the stock up 30% since former google exec took over. it's the third most visited site on the internet. mayer has been ceo a little more than six months. the honeymoon is about over. everyone is ready to hear on this report what it is that

filter in through the day keeping temperatures in the 50s. we'll hit 60s by wednesday. a good looking forecast for outdoor activities as we head through the heart of winter it's unusual to hit the 70s. so for today one of the cooler days. 57 in gilroy for today. offshore flow really starts to pick up tomorrow afternoon. that's when we'll lose the fog. mild conditions. downright mild on wednesday at 64 degrees inland. up to 68 degrees on thursday. and then friday look at that. 69 degrees inland. warmer cities across the bay area, outlying areas hitting mid 70s potentially in santa cruz as well. we'll keep an eye on that for you. mike is keeping an eye on your drive. >> this is a beautiful view of the bay bridge. over the weekend you might have seen those testing of the lights. if you didn't see it, it's on

nbcbayarea.com. look over here out of san francisco you see lower deck and lights very few of them moving smoothly but there is a report of a disabled vehicle as you come across that lower deck in toward treasure island out of san francisco. i'll track it. so far i don't see a real disturbance. watch for a little bit of activity toward that treasure island tunnel out of san francisco. if you get out of oakland, upper deck moves smoothly to the city side. here coming across the westbound commute are headlights across the high rise that's westbound 92. over to foster city and san mateo. a smooth drive for 92. equally smooth eastbound. that's a lighter flow for 101 over toward 880. here's 101 itself northbound through palo alto smooth drive. picking up a few cars southbound also the case. not a big issue. smooth at the limit at the south bay coming down through this corridor of 101. the yellow just dipping down to about 65. no speeds dipping at the bridge.

a small blocking one lane. tri-valley 580 andful no incide. >> thank you very much. interesting twist now on a major bay area story. the father of the man accused of killing sierra lamar is expected to be sentenced for child sex abuse. garcia fernandez was convicted in september on 17 counts of sex crimes against a young family member. he's expected to be sentenced to life in prison. garcia fernandez's son is now being held without bail for kidnapping and murder of morgan hill teenager sierra lamar last march. it is 5:18. menlo park woman and 2-year-old son are thankful to be alive after they were shot over the weekend. police say people inside two cars got into a fight at a stop light around 7:45 saturday night. someone opened fire in one of the cars. the women and boy were both hit

welcome back on a monday morning. day one of the workweek. a live picture of oakland. that's oracle arena home to golden state warriors. a solid season this year. fun to watch. we'll keep you posted on everything happening around the bay area. speaking of oakland a glrowing battle in something designed to bring joy to a city besieged by crime. pg&e wants them removed but others think they should stay. christie smith is live on the little gnome that's becoming a big-time battle. christie, good morning. >> reporter: good morning to you, jon. you can walk by these power poles and not even notice that there is a gnome down at the bottom. when we pulled up, we noticed them on that pole there. the one in the middle and this one where we are standing. they are posted down at the bottom. they are a quirky light hearted twist for a city struggling with violence and painted on little wooden boards and screwed in. as you said, not everyone happy about it. we'll get to that in a minute.

some of them are gnomes. some are more rare. a mushroom next to them. according to the chronicle. the gnome creator is unknown. no one knows who it is. over the past six months they sprouted like mushrooms around the area. there could be by some estimates hundreds of them. according to the chronicle, pg&e which owns some of these poles, want the gnomes removed concerned it could give other people ideas for placing other things on their property and they don't want that. they have also popped up on a cafe around here where the owners say people absolutely love them. we do have calls into pg&e for comment this morning. i tell you, these are pretty easy to find. in oakland, christie smith, "today in the bay." >> thank you very much. >> let's check the forecast right now with meteorologist christina loren. no umbrellas needed today. >> no. that certainly sounds like a first world problem. good morning to you. you don't need a cap to keep

you are out there live this morning. how is it going so far? >> reporter: good, jon and laura. that's not a normal charter. that's the super bowl charter that the 49ers took to new orleans. someone in the nfl really likes coming to new orleans. this is the tenth time the super bowl has been here in the big easy. i have a good idea of why. the super bowl falls in the middle of the mardi gras celebrations that happen here every year. we were able to catch one of those parades yesterday. you see it here going down canal street. the big floats. those things take two months to make. we saw the parade going down canal street. they are going to take a week-long break of the parades in new orleans so this is one of the final ones until the super bowl leaves town here in new orleans. you know who that's a bummer for? for the 49ers who got in late last night and missed the festivities and parade down canal street. the team getting off the plane around 7:00.

two cities. the team may still be called san francisco 49ers but they are also working on that new stadium in santa clara. >> one team, two cities and this year a sports story is being written the bay area has never seen before. marla tellez is live outside the 49ers new stadium they are building in santa clara. good morning. >> reporter: good morning to you. baseball we have the battle of the bay. now it seems we have the battle over the 49ers. the niners first of all as we all know bears the name of san francisco. now they are poised to move to santa clara where the new stadium is being built and where the practice facility has long been. now that they are super bowl bound, both cities have staked a claim to the red and gold. mayor ed lee says he considers the franchise the san francisco 49ers no matter what. on the other hand, the mayor of santa clara tells the mercury news his city is celebrating but doing so low key. he goes on to say no one at city

hall is saying i told you so. speaking of city halls, both city offices are not lit up in red and gold. on homepages you find niner love. santa clara is offering a super bowl pet adoption special all to honor the san francisco 49ers. what about that victory parade? nothing is set in stone just yet. for what it's worth, gavin newsom, former mayor of san francisco, a huge 49ers fan, hoping for another championship parade down market street which implies that parade would happen in san francisco. live in santa clara, marla tellez, "today in the bay." >> either way, no matter where, we have to celebrate. >> have to do something. thank you very much. a lot of niners fans going to sunday's game but we're here to tell you about one extra special fan. >> a longtime niners fan. terry white headed to his sixth niners super bowl and it's all

coming up at 6:00, we'll go live back to new orleans for a look at what the team has going on today. what is going on today weatherwise? let's check in with meteorologist christina loren. >> good morning to you, jon and laura. good morning to you at homes. a good looking day shaping up and a better looking week if you want the warmth. 47 to start you out in san francisco. home of the 49ers. they will get spoiled out there. warm conditions. muggy out there. for us, we'll see traditional bay area pattern for this day. we'll hit our averages. we expect traditional fog that we see at the end of january. not too far from the norms. we'll point out your winds. still pretty strong. sustained at 10 miles an hour out of the west in novato this morning. watch out for that. winds will continue to pick up. we could see gusts up to 40 to 60 miles per hour. the strongest winds are expected near the coastline. you can see that here on the key

road. six cars with flat tires. chp is heading out to check it out. hopefully they don't get a flat tire. lights are out with an earlier accident there. a film based on the true story of oakland's oscar grant took home top honors at the sundance film festival this weekend. >> do you have plans for the night? >> nothing major. >> reporter: the film sta . >> the film chronicled the 24 hours leading up to the b.a.r.t. shooting that killed the unarmed 22 year old. oscar grant's uncle just returned from utah where he attended the film's premiere. >> we knew that this movie would help us share with the world who oscar was. no one is perfect.

i mean, we all should be entitled to some redemptive acceptance in our lives. >> it won the grand jury prize and sundance audience award. it's the first feature length film directed by the 26 year old from richmond. there's no release date just yet. nba star and palo alto native jeremy lin stopping by the festival last night for the final screening of "linsanity." a standing ovation in the packed theater there. filmmaker evan jackson said when he first approached lin about the documentary, lin wasn't excited about it but eventually he did warm up to the idea. >> i'm not kim kardashian or reality. i don't want that kind of attention. i'm just a ballplayer.

in washington, a major announcement is expected on immigration reform. a small group of democratic and republican senators have come up

with a compromise. tracie potts joins us live with details on their plan. >> it could have a huge impact on states like california and the southwest. tomorrow the president will announce his plan but first today we hear from a small group of democrats and republicans who think they have come up with solutions here. they include more border patrol. more agents. more equipment. employer verification. you hire, your responsibility to verify or steeper fines. a guest worker program protecting agriculture jobs that are held by immigrants. green cards for graduates of american universities in math and science, advanced degrees. keeping those people in this country. and a path to citizenship that includes multiple background checks, fines, back taxes paid upfront, probationary period and learning english and physics before you can get to the back of the line.

silicon valley eyeing immigration reform with interest. scott, high tech has its own list of wants. >> the value which wants to keep highly educated immigrants working in high tech. though political parties disagree on a lot of immigration issues on this, they seem united. this couple founded a software firm while attending the university of wisconsin. started hiring their friends. paid almost $1 million in business taxes. and then they had to go home to india because their student visas ran out. the business still exists but it's run out of india with no american employees. everyone agrees that's a problem. republicans seemed willing to solve it right away. democrats resisted wanting to link all immigration issues together. no special treatment for ph.d., business creators, without a deal on the lesser skilled immigrants. democrats won that battle.

very hustle and bustling sfo this morning. you can see the camera shaking around just a touch. that's because we do have winds out there. winds will pick up and play a factor throughout the day today. more wind than fog. very little fog to report here which is good news if you try to catch a flight out of sfo. everything is on time right now. we'll let you know if that changes. we'll get that word ahead at 6:30 each and every day. 38 in san jose. 37 degrees to start this morning in gilroy. grab that jacket. probably want to have a sweater under your jacket. don't need a heavy coat all day long. temperatures will touch on upper 50s and low 60s. with fog formation throughout the morning, this is what we expect. stop the clock at 6:00 a.m. drizzle and thick patches of fog along the peninsula at that point. we stop the clock again at about 9:00 a.m. clearing from santa rosa down to fremont and mostly cloudy in san jose. sunshine early to the north bay will make for the warmest temperatures across the whole bay area. 60 degrees in santa rosa. 60 in san rafael. upper 50s in the south bay.

the court will receive a progress report every 90 days. earlier this month a judge decided goh was incompetent to strand trial. he planned the killing spree after becoming angry with the school officials there over a tuition dispute. 5:48. the retrial of the crime lab drug scandal is coming to an end. closing arguments will be made today in the case of the lab technician accused of taking cocaine from that facility. deborah madden was given a mistrial after jurors couldn't agree on a verdict to her charges that she obtained the drug by fraud or deception. madden's defense lawyers are arguing she did not deceive anyone in the case which is an element needed for conviction under the law. 49ers getting ready for the super bowl, giants trophy tour continues this evening. that world series trophy making an appearance in antioch. fans there can get a glimpse of the antioch community center on 1 lone tree way and a chance to

welcome back. surprising results on a new study on the type of cars we drive. according to researchers from oak ridge national laboratory in tennessee. fuel efficiency drops big-time regardless of the make and model of your car as you increase your speed. it will drop 14% from 60 to 70 miles per hour. new reports this morning say a private investment group wants to buy as much of twitter as it can before that company's stock goes public. that new push to buy twitter kicks that san francisco's value into the stratosphere. >> valuation has to be taken with a grain of salt.

blackrock looking to buy stock from the early shareholders in twitter in anticipation of the company going public. the price blackrock is willing to pay per share gives twitter the $9 billion valuation. "forbes" calculated the value of the san francisco 49ers at more than 1 billion. admittedly that was back at the start of the season. twitter could be worth nine times the 49ers. exxon, the oil company, worth about $418 billion. that makes it the most valuable company in the world above apple which sank to second place following that stock's drubbing last week. on the calendar for today, yahoo! that company will post its financials after the bell. ceo marissa mayer who is just in switzerland for the world economic forum will talk to reporters and analysts. she's been ceo for six months almost exactly. i say this in the nicest way possible, the honeymoon is over.
